There must be other deeds involving this proper.  The other heirs had to sell their interest to property.  It appears to me that Jacob is probably only selling his interest in property.

We know from 1850 Mortality Schedule that both Jacob and Jane died in 1850 for which two coffins needed.  So why is estate paying for three coffins, and obviously Martha Page must have died after census.

Three of those missing were Arwine, Allen and Jacob Page as they deserted after Battle per family.  Allen and Arwine Page later joined in 1864 Co F 4th TN Mounted Infantry.  Allen moved to Marion Co., AK after 1884 and later died In Missouri."

JOHN B. TAYLOR vs STEPHEN ATNIP

It will be seen by reference to the proof of ALLEN PAGE on page 6 of the record that he sold the horse to the plaintiff fairly and bona fide and also by WILLIAM SWINEY on page 6 (who is the execution debter for whose debt the horse was levied on and who the deft insists owned the horse at the time of the levy). He states that the horse was the property of the plaintiff and that he had no claim upon him whatever and that he sold him fairly and bona fide to ALLEN PAGE the witness heretofore spoken of on page 6 for seventy seven and 50/100 dollars and that the whole transaction was fair........BARNEY PAGE states that he was present when plaintiff bought the horse from ALLEN PAGE. ALLEN said he didn't think TAYLOR offered enough and SWINNEY was present and said he thought it was enough plaintiff gave $77.50 for the horse.

WILLIAM SWINNEY proves that he sold the horse in controversy to ALLEN PAGE and PAGE some days after sold her to TAYLOR for seven dollars and 50 cents more than he got from him he was present when the trade was made and gave PAGE the note he held on him and took TAYLOR's note for the horse that he went with plaintiff to the south and had no claim on the horse after he sold him to PAGE, was present when Deft took the horse out of the possession of plaintiff. He took the note on TAYLOR and had not paid PAGE the difference between the notes and being asked if he did not state to WM HAINES(?) a short time after he returned from the south in the Town of Smithville that he sold the horse in the south for a watch and and forty dollars replied that he did not. States he did not recollect of staying at ALLEN PAGES the night before plaintiff bought the horse, thought he stayed at home. Was nothing said between him and PAGE about selling horse to plaintiff or meeting there - he just happen in there. Stated that there is a settlement between him and PAGE. ...

.....The court among other things not excepted to charged the jury as follows, "That if the Jury bvelieves the sale of the horse from SWINNEY to PAGE and from PAGE to Plaintiff was mere col--ble(?) and intended to hinder and delay the creditors of the debts of SWINNEY and might be levied upon in satisfaction of executions against him and if the Jury believes that the horse was in the possession of SWINNEY at the time of this levy by the deft and was still his horse, then they should find for the deft. But, if they believed the plaintiff had in good faith purchased the horse of PAGE or even of SWINNEY then they should find for the plaintiff. That if the horse was the property of SWINNEY and at the time of the levy in his possession, then the execution was sufficient authority to authorize the seizure of the defendant. This was all the testimony in this cause.

From the research of Mitch Jones (Aug 1999) "Arwine Page and Allen and Jacob Page sons of Hezakiah were in Co I 35th TN Inf (Confederate)  After Battle of Shiloh they deserted.  I spent two days with my oldest son hiking two 10 mile trails Boy Scouts set up at Shiloh .  I do not blame them bloody as Battle was.  Bridge 35th was in had 2750 men in battle and had 1000 killed and wounded and 35 missing. Three of those missing were Arwine, Allen and Jacob Page as they deserted after Battle per family.  Allen and Arwine Page later joined in 1864 Co F 4th TN Mounted Infantry.  Allen moved to Marion Co., AK after 1884 and later died In Missouri."

Letter dated March 25, 1999 , Tom Simpson writes: " Last year, my Dad and I tried to go to the cemetery where Hugh Page is supposed to be buried.  It is on Jones Creek, now on private property, just above water line of Center Hill Lake .  The gate had a lock on it and no one was at home at a nearby house.  Per Willis Page, he and DeKalb Co historian, Tommy Webb, think this cemetery on the original land settled by Hezekiah Allen.  Willis said he could remember an old log house that was near.  They also think that this is where Hezekiah and wife are buried.  There are apparently several graves that just have a pile of stones and no head stone."

"Daniel Hale joined the Confederate Army.  He was released and returned home where he was conscripted into the Union Army.  His service in the Union Army caused friction with his brother Reuben.  Daniel drew a pension from serving in the Union Army as Corporal, Co. F, 4th Tennessee Mounted Infantry, from September 26, 1864 to August 25, 1865 Colonel Blackburn was Daniel's commanding officer in the Tennessee Volunteer Mounted Infantry.  Daniel's 6th son, Joseph Blackburn, was named after the colonel.

Daniel Hale was perceived to be somewhat lacking in humor by some of his decendants.  One grandson was named Daniel after his grandfather but refused to use the name -- insisted that he be called Dee .  Daniel was a self proclaimed Methodist minister and was reputed to hear the call to preach at planting and harvesting time.  The calls seemed to always be from distant locations!"

1887 -Seburn Page's land which he purchased in 1873 was sold at public auction on 18 April 1887 to pay off note he was unable to pay. Believed that Seburn Page returned to Texas at this time, taking his wife and younger children with him. His two oldest sons, John Jefferson and William R, children of his lst marriage were married and living in Daviess Co, Ky at this time. (Evidently both sons had returned to TN between 1870-80 for both married Tn girls and some of their older children were born in TN.)

He is buried at Crabtree Cemetery at Clinton in Van Buren Co., Arkansas. Has War Marker at his grave that reads: (Union Marker)  Seburn served as Private in Company F, 25th Tennessee Infantry.  Also in 25Th TN Inf was Arwine and Allen Page.  After Battle of Shiloh they deserted.  The pages certainly had little in common with the slave owning southerns.  They were small land owners and  owned no slaves.  Later these three would join the Union Army.  "Sergt. Seburn Page, Co, F, Fourth Tenn, Mtd. Inf. commanded by Colonel Blackburn.  Also members of Company F were Arwine and Allen Page." His Union records say he was 5 feet 7 inches tall with fair complexion, gray eyes and light hair.
